By accessing or using VideoHub ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Site.

YOU MUST BE AT LEAST 18 YEARS OF AGE to use this Site. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

3.1 Content Review

While we review videos before they are made publicly available, WE DO NOT GUARANTEE the accuracy, completeness, appropriateness, or legality of any content. We are not responsible for user-generated content and assume no liability for such content.

3.2 Your Responsibility

You are solely responsible for any content you upload, submit, or transmit through the Site. You agree that:

You own or have the necessary rights to the content you submit
Your content does not violate any laws or regulations
Your content does not infringe on any third-party rights
All individuals appearing in your content are 18 years or older
You have obtained consent from all individuals appearing in your content

3.3 Prohibited Content

You may not upload content that:

Depicts minors or appears to depict minors
Is non-consensual or depicts non-consensual acts
Violates any local, state, national, or international law
Contains violence, abuse, or illegal activities
Infringes on intellectual property rights
Contains personal information of others without consent

4. COPYRIGHT AND TAKEDOWN PROCEDURES

Your copyright infringement notification MUST include:

Clear explanation of the infringement: Describe specifically how the content infringes your copyright
Direct link to the video: Provide the full URL to the specific video page (e.g., https://teen.net.nz/watch.php?v=12345)
Timestamp/duration (if applicable): If only a portion of the video contains infringing content, specify the exact time range (e.g., "2:45 to 3:30")
Your copyrighted work: Identify and describe the original copyrighted work being infringed
Proof of ownership: Provide evidence that you own the copyright or are authorized to act on behalf of the owner
Your contact information: Full legal name, mailing address, phone number, and email address
Good faith statement: "I have a good faith belief that use of the copyrighted materials described above is not authorized by the copyright owner, its agent, or the law"
Accuracy statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or authorized to act on behalf of the owner"
Your signature: Physical or electronic signature of the copyright owner or authorized representative

Response Timeline

We will acknowledge receipt of valid copyright notifications within 48 hours and take appropriate action within 3-5 business days. Content will be removed or disabled pending investigation if the claim appears valid.

Counter-Notification

If you believe your content was wrongly removed due to a copyright claim, you may submit a counter-notification to the same email address with evidence of your rights to the content.

Repeat Infringers

Users who repeatedly upload infringing content will have their accounts terminated and may be permanently banned from the Site.

5. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless VideoHub, its operators, affiliates, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

Your use of the Site
Your violation of these Terms
Your violation of any rights of another party
Any content you submit to the Site

6. PRIVACY AND DATA PROTECTION

Your use of the Site is also governed by our Privacy Policy. By using the Site, you consent to our collection and use of information as described in the Privacy Policy.

7. ACCOUNT TERMINATION

We reserve the right to terminate or suspend your account and access to the Site at any time, without notice, for any reason, including but not limited to violation of these Terms.

8. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Site constitutes acceptance of the modified Terms.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New Zealand.

10. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
